Revised guidance for Requesting a Work Permit Reprint

2007-02-11

Revised guidance for Requesting a Work Permit Reprint
From 8 February 2007 there is a change to when employers/representatives can request a reprint of a work permit. This change only affects reprint requests when delays arise from overseas nationals’ appeals against Entry Clearance Officers’ (ECO) decisions not to grant leave to enter the UK.

A request for a reprint of a work permit should normally be sent within 6 months of the date of the Appeals and Immigration Tribunal (AIT) determination letter. You should send a copy of the successful AIT determination letter with your request. You should also confirm that the original vacancy remains open, the person is still required, and that the terms and conditions of employment remain the same. Requests submitted outside the 6 month period will only be considered if you can demonstrate a satisfactory reason for the delay. Work Permits (UK) reserves the right to confirm the validity of evidence you provide, which could involve a pre-issue compliance check.

Once the appeal decision is known, the original employer (through a representative, if wished) should request a reprint as soon as possible. You should not wait for the individual to be invited for interview by the ECO or to find out if the ECO will appeal against the appeal decision before requesting a reprint.

Sectors Based Scheme (SBS) - Employers should note that if a request for a reprint of an SBS work permit is refused, for non-resident workers (except Bulgarian and Romanian nationals), employers/representatives will not be able to apply for a fresh Sectors Based Scheme work permit as SBS closed in 2006.

This guidance supersedes previously issued guidance.
